These Terms and Conditions establish the rights and obligations of the Buyer and the Seller when purchasing original artworks and giclée prints in the online shop.

1. General Provisions
   • Parties: These Terms and Conditions constitute a binding legal agreement between the Buyer and the Seller.
   • Agreement: The Buyer agrees to these Terms and Conditions by checking the corresponding box during checkout.
   • Amendments: The Seller reserves the right to amend or supplement these Terms and Conditions at any time.
2. Ordering, Pricing, and Taxes
   • Order Placement: The contract is considered concluded once the Buyer completes the payment for the order.
   • Pricing: All product prices are indicated in Euros (€).
   • Taxes: Product prices include all applicable taxes valid in Lithuania at the time of sale.
   • Import Taxes (Non-EU Buyers): If the Buyer is located outside the European Union (EU), they may be subject to additional import duties, customs fees, or local taxes.
   • Customs Responsibility: All import taxes and customs clearance fees in the destination country must be fully covered by the Buyer.
   • Order Fulfillment: The production of giclée prints begins only after the full payment is received.
3. Shipping and Delivery
   • Timeframe: All items (paintings and prints) are dispatched within 5 business days from the receipt of payment.
   • Shipping Costs: Delivery and shipping expenses are paid by the Buyer.
   • Responsibility: The Seller is responsible for securely packaging the artworks for transportation.
   • Inspection: The Buyer must inspect the condition of the package upon delivery.
   • Damages: If any package damage is detected, a damage report must be immediately filed with the courier.
4. Return Policy and Procedure
   • Return Period: The Buyer has the right to return items in good quality within 14 calendar days.
   • Condition: Returned artwork must be in its original packaging, in pristine condition, and completely undamaged.
   • Fair Use Limit: To prevent abuse, the same Buyer (or same recipient/payer) is permitted to return items in good quality no more than 2 times per calendar year. Returns exceeding this limit will not be accepted.
   • Return Shipping Method (If Delivered by Courier): If the item was received via post, courier, or transport company, it must be returned exclusively by the exact same method it was sent.
   • Return Shipping Method (If Delivered by Artist): If the artwork was delivered personally by the artist, it can be returned at a mutually agreed time and place, or shipped via post/courier.
   • Return Expenses: The Buyer physically covers the return shipping (postal) costs upfront.
   • Refund: Upon receiving the artwork back and ensuring it is undamaged, the Seller will refund the Buyer:
     • The original price of the artwork.
     • The initial shipping costs paid by the Buyer at the time of purchase.
   • Transaction Fees: In the event of a return, third-party transaction or administrative fees are non-refundable (for example, commission percentages deducted by PayPal or other payment processors for the operation).
5. Characteristics of Giclée Prints and Original Artworks
   • Edition and Numbering: Giclée prints are created in strictly defined sizes, limited editions, and each individual piece is unique and numbered.
   • Signature: All giclée prints are personally signed by the artist.
     Colors: Actual colors of the artwork may vary slightly from how they appear on your screen.
   • Certificate: All original paintings and limited edition prints include a certificate of authenticity.
   • Copyright: The purchase of an artwork does not grant the Buyer any rights to reproduce or copy the work.
6. Final Provisions
   • Disputes: All disagreements shall be settled through mutual negotiations or via the State Consumer Rights Protection Authority (VVTAT).
   • Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Lithuania and EU.
